England childcare inspection amendments 2025: preparing for revised inspection outcomes and new independent inspectorate

What the Regulations change

The Regulations amend four instruments relating to childcare and early years provision in England. The changes are made in consequence of changes to inspection grades made by Ofsted, and to make provision for inspections of independent schools by an independent inspectorate approved under section 106 of the Education and Skills Act 2008 (c. 25).

Why this matters for childcare providers

For childcare providers, the reforms mean that inspection outcomes and the newly established independent inspectorate will influence how settings are assessed and how requirements are applied. The changes affect governance, safeguarding, quality of provision, and the ability to demonstrate compliance with early years standards. While Ofsted remains central to the inspection regime, the introduction of an independent inspectorate for some independent schools may alter how such provision is evaluated, requiring updated governance and oversight.

What organisations should do next

Organisations should act to align their policies and governance with the revised framework and prepare for new inspection expectations. Specific actions include:

  • Review current inspection readiness against the updated criteria
  • Update safeguarding policies and governance oversight to reflect new inspectorate expectations
  • Ensure leadership and governance arrangements provide clear accountability for inspection outcomes
  • Communicate changes to staff and trustees and provide targeted training on new processes
  • Monitor guidance from Ofsted and the independent inspectorate and adjust procedures accordingly

Practical guidance for implementation

Establish a simple plan to evidence compliance with the revised framework, including documentation control, risk management and staff training records. Prioritise safeguarding, welfare and quality of learning depending on your setting. Align internal audit cycles with inspection planning and maintain open channels with regulators.
